Pre Council Meeting
April 7, 2009
Meeting called to order by Mayor Edwards at 6:00pm. Present were Mayor Harold M. Edwards, Jr., Councilman
Cameron Andrews, Councilman Randall Wright, Councilman Edward Tucker, City Administrator Patrick Eidson, City
Attorney Rebecca Tydings. Absent: Councilman Robert Smith, Jr.
Old Business
Approval of Bid for GEFA Sentry Oaks Project: City Administrator Eidson provided copy of letter submitted
by Rick Saunders (Saunders Engineering). The city received a total of (9) bids. The prices ranged from
the low ($228,000) to high ($850,000). Rick Saunders recommended to award bid to Cherokee Grading &
Development, LLC. Mr. Saunders consulted with City Attorney Tydings re: verification of financial condition
(Cherokee Grading & Development, LLC). The estimated time for project is 180 days; will have to
have preconstruction conference with EPD.
Utilities Superintendent Brumfield provided recommendation to reduce tap on fees $500.00 to $250.00. City
Attorney briefly discussed the purpose of reducing tap on fees; encourage citizens to tie in on the sewer within
the 180 days of installation. The proposal for the 180 days is based upon the following: 90 days from
completion of the phase that resident section is involved and 90 days to come up with the fee equal 180 days
limit. The incentive is for resident to tie on within the 180 day limit after this time $500.00 fee would
apply. Mayor Edwards stated that this is good to move forward with project and encourage residents to tie in
on sewer versus waiting for problems with septic system. Mayor Edwards recommended payment
plan.
City Attorney Tydings stated agreed with recommendation, try to work with customers. Councilman Tucker agreed but recommended checking payment history of
customers. City Attorney Tydings stated she will look into the possibility of agreements. Agreement
would include amount that would be additional to individual’s monthly water bill for payment and if agreement is
broken their water services could be interrupted.
Mayor Edwards mentioned that the ERC sewer affluent rate fees need to be re-negotiated with City of Warner
Robins. The city has been waiting for a new Agreement offer from Warner Robins for (4) years and has made
numerous attempts to open the discussions. Recommendation to settle this before this Council term ends.
Mayor Edwards suggested that City Attorney Tydings prepare letter and address issue to negotiate ERC re: Sentry Oak
Project. City Attorney Tydings and Utilities Superintendent Brumfield authorized to negotiate easements
necessary for Sentry Oaks project. Mayor and Council agree with recommendation to accept low bid. No
motion or action taken.
Waiver of Water Deposits for Active Duty Military Personnel: City Administrator Eidson has contacted RAFB
(Robins Air Force Base) requesting information on their collection procedures for military personnel. At this
time has not received information, recommendation to table until further documentation available. No motion
or action taken. New Business
Authorization to submit COPS Grant Application: City
Administrator Eidson provided a copy of breakdown for Mayor and Council to review. A projected cost for 2009
Cops Grant Application (3) years cost. This is a DOJ (Department of Justice) Grant Application. Chief
Cooper would like to apply for funding (2) entry level police officer positions. The first (3) years would be
funded at 100% by DOJ. The City would be required to keep these positions for 12 months at the fourth
year.
Mayor Edwards asked if the officer would be required to be mandated. City Administrator Eidson recommended
that the city would hire mandated officers. Councilman Tucker asked Police Chief if this would strengthen
force. Chief Cooper stated “yes”, help to cover shifts.
Councilman Andrews stated that he is in favor. C
City Administrator Eidson stated that the application is due April 14, 2009. There is a review process, no
decision until Fall 2009. The breakdown is attached and made part of official
minutes.
Revision of CC 8 Policy: Mayor Edwards stated that there was a problem a couple of weeks ago re:
Engine 1 (Fire Department) was in need of repairs. The repair had to be approved due to the cost exceeding
City Administrator’s authority to approve expenditure up to $1000.00. Mayor Edwards referenced language in
the old policy section (2):
All purchases exceeding $1000.00 shall be recommended by the City Administrator and City Accountant and
approved by the Mayor and Council.
Mayor Edwards recommended revising policy and adding the following language:
The City Administrator is authorized to exercise discretion in approving purchases exceeding $1000.00
when, in his judgment, it is necessary for uninterrupted provision of essential city services. The City
Administrator shall notify the Governing Authority in writing of any discretionary purchases made within 24 hours
of approval of the expenditure.
Councilman Andrews stated that the City Administrator should be allowed discretion/ responsibility to make a
decision without seeking Council approval. The Mayor and Council should in good faith give City Administrator
the authorization to exceed $1000.00, when it would interfere with daily operations.
Marshallville Police Officer training
reimbursement: City Administrator explained that the officer was assured by Marshallville council members
that he could fulfill his 2 year commitment by working as a part-time reserve officer. Not all of the
Marshallville council agreed and are not going to allow the officer to fulfill commitment by working as a Reserve
Officer. The City of Marshallville is now seeking the statutorily guaranteed refund for 15 weeks of training
and mileage expenses associated with Officer Hollar’s training. Councilman Andrews questioned if the city was
required to refund the City of Marshallville? City Attorney Tydings stated “yes, under Georgia law.”
Police Chief Cooper employment status (March 29, 2009): City Administrator Eidson has provided a
memo with recommendation to terminate 6 month probationary status and change to full time. City Administrator
Eidson stated that he is doing an outstanding job with the Police Department. City Administrator Eidson
commended all Department Heads and stressed they do a great job on behalf of the City. Mayor Edwards
echoed sentiments. Councilman Wright stated the Police Department is run professionally, commending chief and
staff. No motion or action taken.
